What Is Asylum in New Jersey?

Asylum is a protection granted to foreign nationals who are unable to return to their home country due to fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion.

You can apply for asylum in New Jersey if you meet the following requirements:

  • You must have fear of persecution in your home country.
  • You must have arrived in the United States or at a port of entry without inspection or parole.
  • You must have been physically present in the United States for at least 1 year.
  • You must be of good moral character.
  • You must demonstrate that you have been persecuted or fear persecution due to your race, religion, nationality, membership in a particular social group, or political opinion.

If you are unable to return to your home country, you may qualify for withholding of removal. This protection allows you to stay in the United States, but does not offer a path to citizenship. You can apply for withholding of removal if you meet the following requirements:

  • You must have fear of persecution in your home country.
  • You must be able to establish that you would be persecuted if you were returned to your home country.
  • You must have been physically present in the United States for at least 1 year.
  • You must be of good moral character.
  • You must demonstrate that you have been persecuted or fear persecution due to your race, religion, nationality, membership in a particular social group, or political opinion.

It is important to note that withholding of removal is not available to everyone. In some cases, you may be eligible to apply for a different form of relief called "voluntary departure". This allows you to return to your home country under the supervision of the United States government. You cannot return to the United States for a period of 10 years.
