How Do I Obtain Asylum or Refugee Status?
To obtain asylum or refugee status, you will have to prove you either previously experienced persecution on protected grounds or you reasonably fear future persecution. Providing sufficient evidence can be challenging, but our team at Usher Law Group can help you build a persuasive case.
In most situations, you will need to have fled from your home country if you are looking to request refugee status. However, prospective refugees must still apply from outside the United States. You must obtain a referral from the U.S. Refugee Admissions Program (USRAP) before you can formally request refugee protection. Once you have a referral, you will need to gather evidence, fill out the appropriate paperwork, and submit an affidavit. You will eventually meet with an immigration official who will make a final decision in your case.
You can seek asylum status “affirmatively” or “defensively.” If you are already in the United States, you can “affirmatively” (or voluntarily) request asylum protection within one year of your entry. You will need to pursue asylum status defensively if you arrive at a U.S. port of entry or are placed in removal proceedings. Asylum status can be granted as a form of deportation relief if you qualify.
Asylees and refugees can live anywhere in the United States and have permission to work most types of jobs. They are also eligible for green cards after one year. This means asylees and refugees have a potential path to citizenship.
