Waiting is normal in immigration. Waiting without movement, past the agency's own posted times, while the inquiry line repeats that the case is "in process", is a different problem — and there is a tool for it.
What mandamus actually does
A mandamus action asks a federal court to order the agency to decide a case that has been pending unreasonably long. It is important to be precise about the remedy: the court orders a decision, not an approval. If the case is weak, mandamus produces a decision you may not like. If the case is strong and simply stalled, it can end the limbo.
When delay becomes unreasonable
There is no fixed number. Courts weigh how long the case has sat against the agency's own processing times for that form and office, the nature of the benefit sought, the human consequences of continued delay, and whether the delay is explained by something the applicant did or failed to do. A case sitting well beyond published times, with no outstanding request for evidence, is the usual profile.
Try the ordinary routes first
Courts are more receptive when the record shows you asked properly: a case inquiry once outside normal processing times, a service request, an inquiry through the agency ombudsman, and a congressional inquiry through your representative's casework office. These sometimes work on their own. When they do not, they become evidence that the delay is the agency's.
What to have ready
Receipt notices and dates, the posted processing time for your form and office on the date you file, copies of every inquiry and the responses, and proof of the concrete harm the delay is causing — a job offer in jeopardy, a family member stuck abroad, travel that cannot be taken. Specific harm makes an abstract complaint real.
What usually happens
Many of these cases do not reach a judge's decision: once the government has to answer for the delay, the case is adjudicated. That is the practical value of filing. Our mandamus practice handles these in federal court, and we will tell you plainly when a case is not ready to be pushed.
If an application has been pending far past its posted time, send us the receipt notices and we will look at whether it is a candidate.
